01 Scope

These general terms and conditions apply to the contractual relationship between the drum school "Drumstar" (hereinafter referred to as "school") and the student or his/her legal representative.

 

02 Legal relationship

The legal relationships between the school and the student are

of a private nature.

 

03 Subject

The subject of the lesson is jazz and popular drumming technique.

 

04 Duration of lessons

The lessons last 30 minutes, 45 minutes or 60 minutes

 

05 place of instruction

Lessons take place at the school address.

 

06 Tuition fee payment

The tuition fee is to be paid in advance either in cash or by bank transfer or direct debit. The student is liable to pay, in the case of underage students the legal representative. If the contract is terminated prematurely during the semester (semester variant), the fee for the current semester must be paid in full.

 

07 Registration

Registrations are made using the school form. Admission to the school takes place once the contract has been signed by the student or their legal representative and the school. The contract is drawn up in duplicate, each of the contracting parties receives a form. 

 

08 Lesson times and holidays

The lesson times stated on the registration form are binding. Lessons take place all year round (also during the holidays).

 

09 Cancellation of lesson times

If the student cancels at short notice (less than 2 days), the canceled lesson will not be made up for. In general, no hour is made up for the semester block.

 

10 replacements for lost hours

There are no replacement hours in the event of the student's illness and the resulting cancellation of lessons, nor if a lesson is canceled due to force majeure. In the event of prolonged illness, the contract is suspended upon presentation of a medical certificate. 

 

If the teacher is ill, the lesson will be given by another teacher. If this is not possible either, the student has the right to an alternative teaching unit. Hours lost due to illness will not be made up on weekends, public holidays or during vacations

 

11 teachers

Lessons are given by a teacher selected by "Drumstar". There is no right to receive instruction from a specific teacher.

 

12 instruments

The drums are provided by the school for and during lessons. Pupils are not permitted to pass on instruments they have been given to other pupils or third parties.

 

13 Students' Responsibilities

The students are obliged to attend the agreed lessons on time. Regular practice by the students on the instrument is a prerequisite and decisive for the success of the lesson. The instructions of the school staff that concern the safety and order of the school's teaching operations must be followed.

 

14 School Liability

The school is not liable for damage or loss of private property belonging to students. No liability is assumed for injuries of any kind (e.g. joint damage, hearing damage), except in the case of gross negligence or intent on the part of the school. The school is in no way liable for any learning success, but only guarantees lessons by the music teacher, or possibly an equally qualified substitute teacher.

 

15 Liability of Students

The students or their legal representatives are liable for damage caused by the behavior of the students to buildings, premises, inventory, musical instruments, etc. of the school. This liability also includes damage to premises otherwise used by the school as part of its operations. The student or his/her legal representative must indemnify and hold the school harmless for all claims made against the school by third parties as a result of the breach of these contractual obligations. This also includes the obligation to fully indemnify and hold the school harmless from legal defense costs (e.g. court and attorney's fees).

 

16 House Rules

The house rules and fire protection regulations of the place of instruction apply.

 

17 Supervision

The teacher is only responsible for supervising minors for the duration of the agreed lesson after they appear in the classroom. Supervision is only guaranteed for this period. The school therefore assumes no liability for the routes to or from the supervised room.

19 Marketing & Communication Permission
We send information about our services to our students and business partners, e.g. E.g. in the form of a newsletter. In doing so, we adhere to the requirements of data protection.

 

20 Final Provisions

By signing the contract or registration form, the student or their legal representative assures that all information is complete and correct to the best of their knowledge and belief and undertakes to inform the school immediately of any changes to their name and contact details. Until the new address is announced, postal items sent to the last address given to the school are deemed to have been communicated. Austrian law applies exclusively. The place of jurisdiction is the competent court in Vienna, unless another place of jurisdiction is provided for by the Consumer Protection Act. If a provision of this contract, a subsequent change or addition is invalid or ineffective, or if it becomes invalid or ineffective, this does not affect the validity and effectiveness of the remaining provisions of this contract. In the event of the ineffectiveness or invalidity of individual provisions, these are to be replaced by new valid or effective provisions that come as close as possible economically and legally to the invalid or ineffective provision, taking into account the objective of this contract. Further and special agreements that are not listed in the contract and contract supplements must be in writing.

 

21 The reference to the right of withdrawal according to §§ 3f Consumer Protection Act has been made.
